"Build First, Ask Permission Later" Not The Best Plan

"There is a school of thought that it is better to ask for forgiveness than for permission, but in order render such a practice even remotely viable, one must at least try to make it appear as if one is actually asking for forgiveness.”  So says the Land Court in Gattineri v. McGeary, (Mass. Land Ct. Oct. 31, 2016), en route to affirming the denial of an application for modification of a special permit filed several years after construction was completed.
